Privacy Policy | De Tester B.V.
De Tester B.V. (hereinafter: "De Tester") respects the privacy of all individuals whose personal data is processed by De Tester, including visitors to the website www.the-tester.com (hereinafter: "the website"). De Tester considers the careful handling of personal data to be of great importance and processes your personal data in accordance with the General Data Protection Regulation (GDPR). Legal Bases for Processing Personal Data. De Tester processes personal data based on the following four legal grounds:
1) Performance of a contract between you and De Tester or your request to enter into such a contract
This applies when you place an order with De Tester or request to do so. It concerns the delivery of products such as diagnostic self-tests, laboratory test kits, and health equipment (e.g., blood pressure and cholesterol monitors).
In this context, De Tester processes your personal data only to the extent necessary to fulfill the contract. Your data may be shared with third parties if necessary for the execution of the contract. These third parties may include:
- A shipping company contracted by De Tester to deliver your order;
- An online payment provider to process payments made on the website;
- The laboratory that collaborates with De Tester (see below);
- IT service providers for hosting the website and "The Tester-App," database management, and sending order and shipping confirmations as well as checkout reminders.
The Laboratory Partner of De Tester
The laboratory analyzes a sample submitted by you based on a test kit provided by De Tester. You will be informed of the results of this analysis.
Before sending the sample, you must register the laboratory test according to the instructions provided with the test kit. This can be done using "The Tester-App" or another method specified by De Tester. During registration, you must provide your email address, date of birth, phone number, and any other required personal data. These details are transmitted directly to the laboratory, possibly using systems facilitated by De Tester, such as "The Tester-App."
You then send the sample to the laboratory using the provided return envelope. The test results are communicated to you via "The Tester-App" or your account on the website.
Since this involves health-related data, the processing of special categories of personal data occurs. By registering the laboratory test and sending the sample, you explicitly consent to the processing of this sensitive data. However, you are not required to register the laboratory test or submit the sample.
2) Legitimate Interest of De Tester
De Tester may process your personal data when there is a legitimate interest, including:
- The automatic transmission of your data to hosting providers that ensure the operation of the website, "The Tester-App," and email services;
- The use of a CRM system to optimize business processes such as customer management, order processing, and invoicing;
- The provision of your data to an accounting firm for financial administration;
- The use of accounting software to manage De Tester's bookkeeping;
- The use of newsletter software to send you requested newsletters;
- The use of chat software on the website to enable messaging functions.
If you have previously entered into a contract with De Tester, De Tester may send you commercial emails about products or services that may be of interest to you based on that prior contract, without requiring prior explicit consent. You can unsubscribe from such emails at any time using the link provided in the message.
3) Your Consent
De Tester processes your personal data based on your consent when:
- You contact De Tester via phone, email, the contact form, or the chat feature on the website, or when you sign up for newsletters;
- De Tester wishes to use your data for other purposes or share it with third parties.
Your consent applies specifically to a given processing activity and purpose. If De Tester intends to process personal data for multiple purposes, you will be informed, and separate consent will be requested for each.
4) Legal Obligation
De Tester may be required to process certain personal data to comply with legal obligations, such as the retention of invoices for seven years, as prescribed by law.
Transfer of Data Outside the European Economic Area (EEA)
De Tester stores your personal data within the EEA. However, in certain cases, some personal data may be transferred to or stored outside the EEA if an external service provider engaged by De Tester is located there. When this occurs, De Tester ensures that your personal data is processed in a secure and lawful manner by implementing the necessary safeguards.
Access to Personal Data
Only authorized employees of De Tester have access to your personal data, and only to the extent necessary to perform their duties. Individuals working under De Tester’s responsibility, as well as third parties engaged by De Tester, are required to maintain confidentiality regarding your personal data. If De Tester outsources the processing of your personal data to a third party, safeguards such as data processing agreements will be in place to ensure that your personal data remains adequately protected.
Your Rights
You have the right to request the following from De Tester:
Access, deletion, and correction of your personal data;
Restriction of processing;
Objection to processing;
Data portability, meaning you can request your data to be sent in a structured, electronic format.
To exercise your rights, you must submit a request along with a copy of your identification document (with sensitive information such as MRZ, document number, and national identification number redacted). De Tester will respond to your request within four weeks.
If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing carried out before the withdrawal.
You also have the right to file a complaint with the Data Protection Authority of your country if you believe that your personal data is being processed in violation of applicable privacy laws.
Retention of Personal Data
De Tester retains your personal data only as long as necessary to fulfill the purpose for which it was collected. Technical and organizational measures are implemented to protect your data against loss and misuse.
